These Terms and Conditions ("Terms") govern your use of the website located at pittsburgmasonry.com and your engagement of services provided by Pittsburg Masonry & Concrete ("we," "us," or "our"), based at 1052 York St, Pittsburg, CA 94565. By using our Site or requesting our services, you agree to these Terms. If you do not agree, do not use the Site or request services.
By accessing our website or submitting a service request - whether through our online form, by phone, or by email - you confirm that you have read and agree to be bound by these Terms. These Terms apply to all visitors, users, and customers. We may update these Terms at any time. Continued use of the Site or our services after an update constitutes acceptance of the revised Terms.
Pittsburg Masonry & Concrete provides masonry and concrete contracting services in and around Pittsburg, CA, including but not limited to foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, driveway pavers, fireplace installation, stone masonry, and related work.
We reserve the right to decline any service request at our discretion, including projects that fall outside our service area, require licensing or certifications we do not hold, or involve conditions that present a safety risk to our crew.
Written estimates provided by Pittsburg Masonry & Concrete are valid for 30 days from the date issued unless otherwise noted in the estimate. Estimates are based on the scope of work and conditions observed at the time of the on-site assessment. If conditions change or previously unseen issues are discovered once work begins, we will notify you promptly and provide a written change order describing the additional work and its cost before proceeding.
Verbal estimates, phone quotes, or website-based cost ranges are for informational purposes only and do not constitute a binding price commitment. A written, signed estimate is required before any work begins.
Scheduled work dates are confirmed in advance and represent a commitment from both parties. If you need to cancel or reschedule, please notify us at least 48 hours before the scheduled start date by calling (925) 318-8532 or emailing info@pittsburgmasonry.com.
Cancellations with less than 48 hours notice may result in a rescheduling fee to cover crew scheduling costs, particularly when materials have been pre-ordered or equipment reserved for your job. This fee will be communicated to you at the time of cancellation.
We reserve the right to reschedule work due to weather conditions, crew availability issues, or circumstances outside our control. We will notify you as soon as possible and work with you to find the nearest available date.
Payment terms are specified in your written estimate or service agreement. For most residential jobs, we require a deposit before work begins and the balance upon completion. Specific deposit amounts and payment schedules will be stated in your written estimate.
Accepted payment methods will be stated in your estimate. Final payment is due upon completion and acceptance of the work unless otherwise agreed in writing. Unpaid balances beyond 30 days may be subject to a late fee of 1.5% per month on the outstanding amount, and we reserve the right to pursue collection through any legally available means.
Under California law, contractors may place a mechanics lien on your property for unpaid labor or materials. We prefer to resolve payment issues directly, but this option remains available if necessary.
We stand behind our workmanship. Any specific warranty terms for a project will be stated in the written estimate or project agreement. Unless otherwise specified in writing, our workmanship warranty covers defects in installation technique for a period of one year from the date of project completion.
Warranties do not cover damage caused by normal wear and tear, acts of nature (including earthquakes, flooding, or extreme weather events), owner modifications, improper use, or pre-existing conditions outside the scope of the completed work.
Materials warranties, where applicable, are provided by the manufacturer and are separate from our workmanship warranty. We will assist you in making a manufacturer claim where we have that ability.
To the fullest extent permitted by applicable law, Pittsburg Masonry & Concrete shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a specific project shall not exceed the total amount paid by you for that project. Nothing in these Terms limits our liability for gross negligence, willful misconduct, or any liability that cannot be limited under California law.
The content on our website is provided for general informational purposes. While we make reasonable efforts to keep it accurate and current, we make no warranties regarding the completeness, accuracy, or fitness for a particular purpose of any content on the Site.
You may not use our Site for any unlawful purpose, to transmit harmful or malicious content, to attempt to gain unauthorized access to our systems, or to interfere with the operation of the Site in any way.
If a dispute arises between you and Pittsburg Masonry & Concrete related to our services or these Terms, we ask that you contact us first to try to resolve it directly. Most issues can be resolved with a direct conversation. You can reach us at info@pittsburgmasonry.com or (925) 318-8532.
If a dispute cannot be resolved directly, any claim or dispute arising from or related to these Terms or our services shall be resolved through binding arbitration in Pittsburg, CA in accordance with the rules of the American Arbitration Association, except where such arbitration is prohibited by law. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any legal proceedings not subject to arbitration shall be brought in the courts of Contra Costa County, California.
